effective [EFFECTIVE DATE]

draft, not legal advice

This document is a working draft. It must be reviewed by a qualified lawyer before Nolemo charges real users. Every bracketed value below (for example [COMPANY LEGAL NAME], [JURISDICTION], [CONTACT EMAIL], [EFFECTIVE DATE]) is a placeholder that a human still has to fill in.

These Terms of Service (the “Terms”) govern your access to and use of Nolemo, a learning product operated by [COMPANY LEGAL NAME] (“Nolemo”, “we”, “us”). By creating an account, starting the diagnostic, or paying for access, you agree to these Terms. If you do not agree, do not use the product.

1. The product

Nolemo is a paid learning service. It maps what you know, tracks what is fading, and schedules practice through an adaptive engine (diagnostic placement, spaced review, prerequisite gating). Access to lessons, reviews, and the atlas requires an active paid plan. There is no free plan. The diagnostic is offered as a public preview of how placement works and does not by itself grant ongoing access.

2. Accounts

You need an account to use Nolemo. You register with an email address (verified by a one-time link) or through Google, GitHub, or Apple sign-in; there are no passwords. You are responsible for keeping your email account and sign-in links secure and for all activity under your account. You must be old enough to form a binding contract in your jurisdiction, and at least the minimum age required by applicable law, to hold an account. Provide accurate information and keep it current.

3. Payment, plans, and billing

Paid access is sold through our payment processor, Stripe. Depending on the plan you choose, access may be billed as a one-time purchase or as a recurring subscription. Prices are shown at checkout before you pay. Nolemo is priced as a premium product and may adjust regional pricing using purchasing-power-parity factors; the price you see at checkout is the price you pay for that transaction.

For subscriptions, you authorize us and Stripe to charge your payment method on each renewal until you cancel. You can cancel a subscription at any time from your profile (manage billing); cancellation stops future renewals and takes effect at the end of the current billing period. Paid access includes a 7-day refund from purchase, no questions asked. After that, and except where required by law, payments are non-refundable. Taxes may be added where applicable. We do not store your card details; card data is handled entirely by Stripe (see the Privacy Policy).

4. Acceptable use

Your access is for your own personal learning. You may not share, resell, or sublicense your account or paid access; scrape, copy, or redistribute the curriculum, exercises, or engine output at scale; attempt to bypass the paywall, plan gating, or usage limits; probe, attack, or disrupt the service or its infrastructure; upload malicious code through the code labs or any other input; or use the product to break the law or infringe someone else's rights. We may suspend access to protect the service or other users while we investigate suspected abuse.

5. Your content

You keep ownership of what you submit, including code you write in the labs and answers you give. You grant us a limited license to store and process that content to operate the service, run the learning engine, and improve the product. The curriculum, software, designs, and brand remain ours or our licensors'.

6. Termination

You may stop using Nolemo and close your account at any time from your profile (delete account), which also deletes your data as described in the Privacy Policy. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the service. On termination your right to use the product ends. Sections that by their nature should survive (payment obligations already incurred, disclaimers, limits of liability) survive termination.

7. Disclaimer of warranties

Nolemo is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that using the product will produce any particular learning outcome, score, or result, or that the service will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, [COMPANY LEGAL NAME] will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the product. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

9. Changes to these Terms

We may update these Terms as the product evolves. When we make material changes we will update the effective date above and, where appropriate, notify you. Continuing to use Nolemo after a change takes effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws rules. The courts located in [JURISDICTION] will have exclusive jurisdiction over any dispute, unless mandatory law in your country of residence provides otherwise.

11. Contact

Questions about these Terms can be sent to [CONTACT EMAIL]. See also our Privacy Policy.
